Food Safety and Standards Authority of India

FSSAI is an authority to provide a food license to every food business in India. FSSAI makes sure that the food business runs with appropriate license and a quality check. The food businesses are required to follow the FSSAI rules and guidelines. FSSAI is in entirely responsible for setting the standard and principles and controls for the welfare of food businesses in India

FSSAI Registration

FSSAI registration is required for all petty food business operator. Petty food business operator is any person or entity who:

1. Manufacturers or sells any article of food himself or a petty retailer, hawker, itinerant vendor, juice stall, sweets shops or temporary stall holder; or

2. Hawker selling packaged or freshly prepared food by travelling on movable cart or foot from one location to other.

3. Small scale or cottage or such other industries relating to food business or tiny food businesses with an annual turnover not exceeding Rs 12 lakhs and whose:

4. Production capacity of food (other than milk and milk products and meat and meat products) does not exceed 100 kg/ltr per day or

5. Procurement or handling and collection of milk is up to 500 litres of milk per day or

6. Slaughtering capacity is 2 large animals or 10 small animals or 50 poultry birds per day or less.

Petty food business operators are required to obtain a FSSAI registration by submitting an application for registration in Form A. On submission of a FSSAI registration application, the registration should be provided or application rejected in writing within 7 days of receipt of an application by authority.

FSSAI license is of three types, Basic FSSAI Licence, State FSSAI License and Central FSSAI License. Based on the size and nature of the business, the licensing authority would change.

Basic FSSAI Registration

If the annual turnover of a food business is below Rs. 12 lakh then basic registration of food licensing is required. Generally, when someone is starting up a business and unsure of expected turnover, basic food safety registration is done which can be upgraded to state license if the turnover exceeds Rs. 12 Lakh.

Dairy having capacity less that 500 liters per day or daily manufacturing capacity less than 100kg per day needs to get basic FSSAI registration which includes wide range of businesses starting from small pan shops, tea stalls, home based food operators, small warehouses, canteen’s , mid day meal services and food processors. The maximum tenure of this license is 5 years and the minimum is 1 year.

State FSSAI License

If the annual turnover of the food business is more than Rs. 12 lakhs and less than Rs. 20 crores then one has to get state FSSAI License.

Manufacturing units having capacity up to 2 MT per day, Dairy units handling business up to 50000 liters per day, 3 star hotels and above, re-packers and re-lebelling units, clubs canteens, all the catering business irrespective of their turnover needs to apply for State licence. The maximum tenure of this license is 5 years and the minimum is 1 year

Central FSSAI License

If the annual turnover of the food business is more than Rs. 20 Crores then central FSSAI License is required.

Now the businesses which do not fall under the above two categories, they need to go for central licence, the importer and exporters mandatorily needs central licence, in case you are in a business having multiple outlets across the country then you need to go for central licence for your registered address and also need to get basic state or central licences depending on the turnover of each outlet. FSSAI LICENSE VALIDITY

FSSAI license validity reaches out from 1 to 5 years and it relies on the number of years which is picked by the nourishment administrator. The expense of the permit anyway increments with the number of years which he has connected for. According to the FSSAI rules, the food business operator needs to apply for the renewal of the license in 30 days and it should be done before its expiry. Any FSSAI Renewal Application filed beyond the expiry date is subjected to a late fee of Rs.100 for each delayed day.

FSSAI RENEWAL

In India, FSSAI registration or Food License is fundamental for every food business operator before starting the food business. FSSAI License is similarly imperative to be renewed within the time period or before it expires. The food license issued to the food business operator can have a validity of 1 year or up to 5 years. FSSAI registration fees vary as per tenure of the FSSAI License. As per the FSSAI rules, each food business operator needs to apply for FSSAI renewal 30 days before the expiry of the current food license.

Penalty on FSSAI Licence Renewal: If the application for FSSAI License (state and Central) renewal isn't documented in the stipulated time, then Rs. 100 per day would be fined for FSSAI Licences.

Penalty on FSSAI Registration Renewal: If Renewal of Food registration isn't done within the stipulated time then it will be considered as a gap and a new license would need to be applied by the food business operator to continue the business further.

The License or FSSAI registration will keep on being in power till time arranges on the FSSAI renewal application are passed that must be past 30 days from the date of expiry of FSSAI license.
